1. Agreement to Terms
By creating an account or using Cadenly ("the App"), you agree to these Terms of Service ("Terms"). If you do not agree, do not use the App. Cadenly is operated by Cadenly ("we", "us", "our").
2. Eligibility
You must be at least 18 years old to use Cadenly. By creating an account, you confirm that you are 18 or older. We reserve the right to request proof of age and to terminate accounts that do not meet this requirement.
3. Your Account
You create an account using Apple Sign In or Google Sign In. You are responsible for maintaining the security of your account and for all activity that occurs under it. You agree to provide accurate information in your profile, including your sport, pace range, and location. Deliberately misleading information (such as false pace ranges or locations) may result in account suspension.
You may delete your account at any time through Settings → Delete Account. This permanently removes your profile, messages, session posts, events, and uploaded files.
4. What Cadenly Does
Cadenly connects cyclists and runners with potential training partners based on pace, sport, location, and availability. We provide the platform for discovery and communication. We do not organise, supervise, or take responsibility for any training sessions, rides, runs, or events arranged through the App.
Cadenly is a platform for finding training partners. Any physical activity you undertake with people you meet through Cadenly is entirely at your own risk and responsibility.
5. Acceptable Use
You agree to use Cadenly respectfully and lawfully. You must not: use the App for any purpose other than finding training partners and organising athletic activities; harass, threaten, or abuse other users; create fake profiles or impersonate others; share another user's personal information or location without their consent; post content that is offensive, discriminatory, sexually explicit, or promotes violence; use the App to send spam, advertisements, or solicitations; attempt to access other users' accounts or interfere with the App's operation; or use automated tools or bots to interact with the App.
6. Content You Post
You retain ownership of content you create (session posts, events, messages, photos, GPX files). By posting content on Cadenly, you grant us a limited, non-exclusive licence to display that content to other users as part of the service. When you delete content or your account, we remove it in accordance with our Privacy Policy.
You are responsible for ensuring that any content you post does not violate the rights of others, including intellectual property rights.
7. Safety and Physical Activity
Training with others involves inherent risks. Always exercise good judgment when meeting someone for the first time.
Cadenly does not verify the identity, fitness level, or intentions of its users beyond the information they provide. We strongly recommend: meeting new training partners in public, well-populated areas for your first sessions; informing a friend or family member of your plans; carrying a phone with you during training; following all applicable traffic laws and local regulations during rides and runs; and assessing weather and route conditions before heading out.
We are not liable for any injury, loss, or damage arising from training sessions, events, or meetups arranged through the App. You participate in all physical activity at your own risk.
8. Events
Users can create and join events through the App. Event organisers are responsible for the accuracy of event details (date, time, location, route, pace). Cadenly does not verify event details or provide insurance for events. Participation in events is voluntary and at your own risk.
9. Reporting and Moderation
You can report users or content that violates these Terms. We review reports and may take action including: issuing warnings, temporarily suspending accounts, or permanently banning users. We may also remove content that violates these Terms. Our moderation decisions are at our sole discretion.
10. Blocking
You can block other users at any time. Blocked users cannot view your profile, send you messages, or see your session posts. You will not see their content either.
11. Subscriptions and Payments
Cadenly may offer premium features through a paid subscription in the future. Any subscriptions will be processed through Apple's App Store and subject to Apple's payment terms. We will update these Terms before introducing paid features.
12. Intellectual Property
The Cadenly name, logo, and app design are our property. You may not copy, modify, or distribute our branding or app code without written permission. The App is provided for personal, non-commercial use only.
13. Limitation of Liability
To the maximum extent permitted by law, Cadenly and its operator shall not be liable for: any indirect, incidental, special, or consequential damages; loss of data, revenue, or profits; personal injury or property damage resulting from your use of the App or from meetups arranged through the App; actions of other users; service interruptions or technical failures.
Our total liability for any claim arising from your use of the App shall not exceed the amount you have paid us in the 12 months preceding the claim, or €50, whichever is greater.
14. Disclaimer
Cadenly is provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not warrant that the App will be uninterrupted, error-free, or secure. We do not endorse any user or guarantee the accuracy of any user-provided information.
15. Termination
We may suspend or terminate your account at any time if you violate these Terms or if we reasonably believe your behaviour puts other users at risk. You may terminate your account at any time through Settings → Delete Account. Upon termination, your right to use the App ceases immediately.
16. Changes to These Terms
We may update these Terms from time to time. We will notify you of significant changes through the App. Your continued use of the App after changes take effect constitutes acceptance of the revised Terms. The "Last updated" date at the top indicates the latest revision.
17. Governing Law
These Terms are governed by the laws of Poland. Any disputes shall be subject to the exclusive jurisdiction of the courts in Warsaw, Poland, unless mandatory consumer protection laws in your country of residence provide otherwise.
